Welcome to Ella Monterey. These Terms of Service apply to your use of ellamonterey.com and to any purchase you make through our website. By accessing our website or placing an order, you agree to these terms. If you do not agree, please do not use our website.

We sell to customers in the United States. Your order is fulfilled through our manufacturing and fulfillment partners, some of whom are located outside the United States.
USING OUR WEBSITE
By using this website you confirm that you are at least 18 years old, or that you have permission from a parent or guardian. You must not use our website or products for any unlawful or unauthorized purpose.
PRODUCT INFORMATION
We do our best to display product descriptions, colors, sizes, images and details accurately. Colors may appear slightly different depending on your screen, device and lighting, and packaging or minor design details may vary from the images shown.
Product descriptions, specifications and prices may change at any time without notice.
PRICING AND CURRENCY
All prices are shown in U.S. dollars unless stated otherwise at checkout, and are exclusive of any sales tax, which is calculated and displayed at checkout where required.
We reserve the right to correct errors in pricing, product information or availability. If your order is affected by an obvious error, we will contact you to correct it or cancel the order and issue a full refund to your original method of payment. We will never charge you more than the price shown at checkout without your agreement.
Because we are based in the Netherlands, your bank or card issuer may treat your purchase as an international transaction and apply a foreign transaction fee. Any such fee is charged by your bank, not by us.
ORDERS AND WHEN A CONTRACT IS FORMED
When you place an order, you confirm that the information you have provided is accurate and complete, and that you are authorized to use the payment method selected.
The order confirmation email we send is an acknowledgment that we have received your order. A binding contract is formed only when we dispatch your order or confirm acceptance in writing. This allows us to address issues with payment, stock, pricing, address details or suspected fraud before the contract is formed.
REFUSING OR CANCELING ORDERS
We may refuse, cancel or limit any order, including where there is:
- Incorrect or incomplete customer information
- A payment issue or failed authorization
- Suspected fraud or unauthorized use of a payment method
- A product availability issue
- A pricing or listing error
- Unusual order activity, such as quantities inconsistent with personal use
If we cancel an order after payment has been taken, we will refund you in full to your original method of payment.
SHIPPING
Shipping and delivery times are good-faith estimates, not guarantees. Please see our Shipping Policy for processing times, delivery windows, carriers, customs duties and how we handle delays.
If we cannot ship your order within the timeframe stated in our Shipping Policy, we will notify you, offer a revised date and give you the option to cancel for a full refund, in line with the Federal Trade Commission's Mail, Internet, or Telephone Order Merchandise Rule.
RETURNS AND REFUNDS
Returns, exchanges, cancellations and refunds are handled according to our Returns and Refund Policy, which forms part of these terms and includes our 30-day money-back guarantee.
PAYMENT
We accept the payment methods shown at checkout, which may include credit and debit cards, Apple Pay, Google Pay, PayPal and Shop Pay. Payments are processed by third-party providers under their own terms. We do not store full card details.
YOUR ACCOUNT
If you create an account, you agree to provide current, complete and accurate account, billing and shipping information, and to keep your login details secure. You are responsible for activity that takes place under your account. Tell us promptly at info@ellamonterey.com if you believe your account has been accessed without your permission.

SEVERABILITY
If any provision of these terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining terms will stay in full effect.
